REGULAR COUNCIL MEETING

MAY 13, 2019

FINANCE COMMITTEE:  Met in the water dept. bldg. on 5/13/19 at 1:30 p.m.

PRESENT:  Mayor, Art Nutzhorn, Donna Lefler (absent) (1st ward), Connie Jacobson, Gene Gibler (old business), Jason Musselman (new business) (2nd ward), Rob Finney (absent), Ryan Kelly (3rd ward), Barbara J Cantwell, Michael Evans city attorney.

CALL TO ORDER:  Mayor Hollis called the regular meeting to order at 6:18 p.m. and led the Pledge of Allegiance to the Flag.

MINUTES OF THE APRIL 82019 MEETING: The First page under Approval of Submitted Claims2nd sentence delete the word to and replace it with instead of.  2nd page under Ordinance #897 Sexual Harassment 2nd sentence last word laws change to policy.  Under Public Concerns, 2nd sentence change“Ryan wants to start looking for a new attorney” to“wants to resolve the attorney situation.”  Art Nutzhorn made a motion to accept the minutes for the April 8, 2019 meeting as amended.  Gene Gibler 2nd motion passed.  

MINUTES OF THE APRIL 18, 2019 SPECIAL MEETING:  Under Present: remove Michael Evans city attorney, he was not present.  Connie Jacobson made a motion to accept April 18, 2019, special meeting as amended.  Art Nutzhorn 2nd motion passed.

CASH RECEIPT REPORT:  Total cash receipts for the month of April 2019 is $76,907.83.  Ryan Kelly made a motion to accept the Cash Receipt Report for the month of April 2019.  Art Nutzhorn 2nd motion passed.

TREASURER REPORT:   Treasurer Report for the month of April 2019 is $820,358.75.  Art Nutzhorn made a motion to accept the Treasurer Report for the month of April 2019.  Gene Gibler 2nd motion passed.

REPORTS FROM CITY EMPLOYEES/COMMITTEE CHAIRMEN:  Rob Kamerer reported that the city employees have been cleaning the city streets on S. Franklin and S. Miller.  There was a sewer line collapsed on N Miller that has been repaired.  The service going to the house had also collapsed.  Started on updating the sewer plant this week (week of 5/13).  City employees will assist in running wires and conduit and groundwork.  There are 2 trees left in the cemetery to pick up and a tree at the dog park to clean up.   Art Nutzhorn would like the Mausoleum open for the weekend of Memorial Weekend.  Rob Kamerer reported that a stain glass window has been broken.  It needs to be cleaned up before opening.  Ryan Kelly asked about the burn pile at the sewer plant.  

APPROVAL OF SUBMITTED CLAIMS:  Connie Jacobson made a motion to accept the claims as submitted for the month of April 2019.  Art Nutzhorn 2nd motion passed.

ATTORNEY REPORT:    Michael Evans reported he is waiting on the survey of the Bent property from the surveyors.  Also waiting on the school for the concession stand.  There is a signed contract but no legal description to go with it.  Mr. Evans has to do an Ordinance for Mediacom.  They are changing the way the tax is being assessed for cable TV.  Golf cart ordinance is done but didn’t get emailed to the City.  Will have it on the agenda next month.  Mr. Evans reported talking to Wyoming about the conflict with the scheduling of the meetings and his attendance at both meetings.  Wyoming was going to talk about changing their time to 6:00 and asked Toulon to change our time to 6:30 to start our meetings because their meetings never last very long.  Then he would be able to be at ours longer.

BUDGET:   Held over to next month.

Mayor Hollis did the swearing in the new alderman of Jason Musselman and swearing in the returning alderman Art Nutzhorn.  Rob Finney is also a returning alderman but was absent from the meeting.

PUBLIC CONCERNS:  Jake Streitmatter asked if it could be looked into getting a swing that holds the adult and the child.  Jason Musselman would like a notice of security cameras in the park.  

Larry asked for a motion to move the Resolution MFT 2019 program to the bottom of the new business.  Jason Musselman so moved the MFT program be moved and  Art Nutzhorn 2nd motion passed.

COMMITTEES:   Mayor Hollis left the committees the same just removed Gene Gibler’s name and added Jason Musselman in his place and made Jason Musselman chairman of the Parks Committee.

PLATE COMPACTOR:  This piece of equipment will help compact the ground when there is a hole that needs to be filled.  Ryan Kelly made a motion to purchase the plate compactor from Menards for $569.00.  Jason Musselman 2nd motion passed.

APPARTMENTS ON MAIN STREET:    Mayor asked Mr. Evans if an ordinance can be passed to prohibit any ground level apartments starting up on Main St. in the future from Miller Street to Henderson Street.  Everyone that has an apartment currently will be grandfathered in.  

ORDINANCE #898 W/TOULON MARKET LLC:  Jason Musselman made a motion to ratifying Ordinance #898 approving the authorization of the TIF Redevelopment Agreement.   The motion fails for the lack of a 2nd.  Jason Musselman made a motion to table the Ordinance #898 for a special meeting.  Connie Jacobson 2nd motion passed.

DOG PARK:   The property next to Ryan Kelly’s house originally was owned by the Rennick family and was given to the City under the stipulation that it is used as a park or a green space.  The area got a nickname of the Dog Park.  Dogs are running loose in this area.  There needs to be a fenced-in area if it’s going to be a Dog Park.  Jason Musselman made a comment about having a park committee meeting and talking about having a dog park at the subdivision in lot #1.

SIDEWALKS:  The Mayor wants to put in some more sidewalks.  The Mayor would like to do a streetscape in the downtown area.  This project goes thru IDOT.  This would be new lighting and sidewalk improvements.  Jason Musselman spoke of the school crossing lights at main not working.  

MFT RESOLUTION 2019 PROGRAM:  This program is to repair the city streets.  Jason Musselman made the motion to approve the MFT resolution 2019 program.  Connie Jacobson 2nd motion passed.

TIF BUSINESS:  Jason Musselman made a motion to approve the Jacob & Klein 1st quarter bill for $458.90 and the Economic Development Group bill for $1,835.60.  Ryan Kelly 2nd motion passed.  

Connie Jacobson made a motion to approve the FY2020-1 Roach & Family bill for $2,000.00 & when the work is done on Dowend Street for $9,250.00.  Art Nutzhorn 2nd motion passed.  Jason Musselman made a motion to approve the 4 payments to Teresa Macy for TIF Assistant in the amount of $2,000.00 total.  Art Nutzhorn 2nd motion passed.  Jason Musselman made a motion to approve the Esco bill $3,251.68 and repay Gen Savings for $305.00 ½ of police body cams and to pay BEA for $1,246.76.  These are line items 5,6,7,8 & 10 on the FY2020-1 TIF request.  Art Nutzhorn 2ndmotion passed.

Jason Musselman would like the City of Toulon to have a Facebook page.  Jason would like to present at the next council meeting a policy on the city’s FB page on the electronic pickup, when trash pickup days are, burn days, etc.
